1. Acceptance of Terms

By accessing or using AgriSmart Ghana (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use the Service. These terms apply to all visitors, registered users, and subscribers.

2. Description of Service

AgriSmart Ghana is an AI-powered digital farming platform that provides: (a) AI Crop Assistant — personalized crop management recommendations; (b) Disease Detection — AI-powered identification of crop diseases from uploaded photos; (c) Livestock Manager — tracking of animal health, vaccinations, and growth records; (d) Weather Intelligence — localized weather forecasts; (e) Farm Calendar — scheduling of planting, irrigation, fertilization, vaccination, and harvesting activities; (f) Farm Records — financial tracking of income and expenses; (g) Marketplace — buying and selling of produce, livestock, inputs, and equipment; (h) Price Predictor — AI-driven market price forecasts; (i) AI Chat Assistant — conversational farming guidance with voice output in English, Twi, Ewe, Ga, and Dagbani; (j) Community Forum — peer-to-peer knowledge sharing; (k) Training Resources — educational videos, articles, and webinars; (l) Subscription management with a 14-day free trial; and (m) Contact Us form with automatic confirmation email. The app automatically synchronizes your user profile, subscription status, and marketplace data with the server when the app resumes from the background, when network connectivity is restored, and periodically while the app is open — no manual logout is required to see updated data. We reserve the right to modify, suspend, or discontinue any feature at any time with or without notice.

3. User Accounts

You must provide accurate and complete information when creating an account. You may register via email and password or Google Sign-In. You are responsible for safeguarding your credentials and for all activity conducted under your account. You must be at least 18 years old to use this Service. One person or entity may not maintain more than one account. You must notify us immediately of any unauthorized use of your account. To post listings on the marketplace and access other verified-user features, you must complete identity verification by submitting your Ghana National ID card (Ghana Card) and a live selfie captured through your device camera. When you submit your Ghana Card, the front-side image is processed by AI-based optical character recognition (OCR) to automatically extract your full name, card number, date of birth, and other printed details. Your selfie is then compared against the portrait on your Ghana Card using an open-source face-recognition engine, and a randomized liveness challenge may be issued to confirm the selfie is live. You must review and confirm the extracted data before submission, and you must explicitly consent to the collection and processing of your facial biometric data before verification begins. One Ghana Card may be linked to only one account — attempting to register the same Ghana Card on multiple accounts is prohibited. Your card images, selfie, face embeddings, and extracted identity data are stored securely and reviewed by our administrators when automatic confidence is low. Providing false, altered, or another person's Ghana Card, or attempting to spoof the selfie or liveness check, is a violation of these Terms and may result in immediate account suspension.

4. Subscription, Billing & Free Trial

Certain features require a paid subscription. We offer three plans: Basic (GHS 50/month), Pro (GHS 100/month), and Enterprise (GHS 250/month). New users receive a 14-day free trial with access to Pro features — no credit card required to start. At the end of the trial, access to premium features is restricted until a subscription is purchased. Subscriptions are processed through Paystack. Two billing methods are available: (a) Auto-renewing card subscriptions — billed monthly in advance, automatically renewing each cycle unless cancelled, with cancellation taking effect at the end of the current billing period; and (b) One-time Mobile Money payments — granting 30 days of access with no auto-renewal, requiring manual re-subscription to continue. You may cancel auto-renewing subscriptions at any time. Payments are non-refundable except where required by law. Refunds for unused portions are issued at our sole discretion. We reserve the right to change pricing with at least 30 days' notice before the next billing cycle.

5. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose or in violation of any local, state, national, or international law; (b) post false, misleading, fraudulent, or harmful content; (c) attempt to disrupt, overload, or compromise system security; (d) scrape, reverse-engineer, decompile, or disassemble the platform; (e) use automated bots or scripts to access the Service without authorization; (f) violate the intellectual property rights, privacy, or other rights of any third party; (g) upload content containing malware, viruses, or harmful code; (h) impersonate another person or entity; (i) use the marketplace for illegal goods or services; or (j) harass, abuse, or threaten other users in the community forum.

6. User Content

You retain ownership of all content you post or upload, including community forum posts and replies, marketplace listings and images, crop photos for disease detection, farm records, livestock entries, and calendar events. You grant AgriSmart Ghana a non-exclusive, royalty-free license to host, store, display, process, and distribute such content solely for operating the Service and providing the features you request. You are solely responsible for the accuracy, legality, and appropriateness of your content. You represent that you have all necessary rights to the content you upload and that it does not infringe any third-party rights. We reserve the right to remove content that violates these Terms or is otherwise objectionable.

7. AI-Generated Advice & Disclaimers

AgriSmart Ghana provides AI-powered tools including crop recommendations, disease detection, price predictions, and chat assistance. All AI-generated outputs are informational only and are not a substitute for professional agricultural, veterinary, financial, or legal advice. AI results may be inaccurate, incomplete, or outdated. You are solely responsible for any decisions or actions you take based on AI-generated content. AgriSmart Ghana is not liable for crop loss, livestock harm, financial losses, or any other damages arising from reliance on AI output. Always consult a qualified agricultural extension officer or veterinarian for critical decisions.

8. Disease Detection & Image Uploads

When you upload photos of crops or leaves for disease detection, you grant us permission to process those images using AI vision models. Results are probabilistic and may not identify the correct disease in all cases. AgriSmart Ghana does not guarantee the accuracy of diagnoses. Treatment suggestions provided are general guidance only — always consult a qualified expert before applying any chemical treatment to your crops.

9. Livestock Management

The Livestock Manager allows you to track animal health, vaccinations, and growth records. This tool is for your personal record-keeping and does not constitute veterinary advice. Vaccination reminders are based on dates you enter and may not account for specific animal health conditions. Always consult a licensed veterinarian for medical decisions regarding your animals.

10. Weather & Price Predictions

Weather forecasts are sourced from third-party providers and may not always be accurate. Price predictions are generated by AI based on available market data and are not guaranteed. Agricultural decisions should not be based solely on these forecasts. AgriSmart Ghana is not liable for losses resulting from reliance on weather or price prediction data.

11. Marketplace Transactions & AI Agents

The AgriSmart marketplace connects buyers and sellers of agricultural products, livestock, inputs, equipment, and services. AgriSmart Ghana is not a party to transactions between users and does not facilitate payments between buyers and sellers (unless explicitly stated). We are not responsible for the quality, safety, legality, or delivery of listed items. You transact with other users at your own risk. Sellers are responsible for providing accurate listings and for complying with all applicable laws regarding the sale of goods. Only users who have completed Ghana Card identity verification may post marketplace listings. Contact information you share in listings (e.g., phone numbers) is publicly visible to facilitate transactions. The marketplace is enhanced by autonomous AI agents that automatically validate listings, generate pricing insights, assess fraud risk, moderate content, produce recommendations, evaluate seller performance, and provide AI customer support. These agents may approve, flag, freeze, or reject listings based on their analysis. Administrators retain oversight and may override AI decisions. You may file a dispute against a listing, which will be analyzed by AI and reviewed by our team. You may submit star ratings and reviews on listings, which are subject to AI moderation. Seller trust scores and verified badges are computed from marketplace activity and are not guarantees of seller reliability.

12. Community Forum

The community forum allows users to share knowledge, ask questions, and post success stories. You agree to participate respectfully and not post content that is defamatory, abusive, hateful, or otherwise harmful. You are solely responsible for your forum posts and replies. We reserve the right to moderate, edit, or remove content and to suspend users who violate forum guidelines. Forum content is public and visible to all users.

13. Training Resources

Training resources (videos, articles, PDFs, webinars) are provided for educational purposes. Access to certain resources may be limited based on your subscription plan. Content is owned by AgriSmart Ghana or licensed from third parties. You may not download, redistribute, or republish training materials without explicit permission. External links within training resources are provided for convenience and are not endorsed by us.

14. Google API Services

AgriSmart Ghana uses Google API services (including Google Sign-In, Google Calendar, and Google Drive) to provide certain features. Your use of Google API services is subject to Google's applicable terms and the Google API Services User Data Policy, including the Limited Use requirements. You may revoke Google API access at any time from your Google Account settings. Disconnecting a Google service will disable the associated features.

15. Intellectual Property

All platform content, branding, software, design, logos, and code — excluding user-generated content — are the property of AgriSmart Ghana and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our materials without prior written permission. 'AgriSmart Ghana' and associated marks are trademarks of the platform.

16. Limitation of Liability

AgriSmart Ghana is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, crops, livestock, or revenue arising from your use of or inability to use the Service. We do not warrant that the Service will be uninterrupted, error-free, or secure. Our total liability for any claim arising from the Service shall not exceed the amount you paid in the preceding 12 months.

17. Indemnification

You agree to indemnify and hold harmless AgriSmart Ghana, its officers, employees, and partners from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the Service, your content, your marketplace transactions, or your violation of these Terms or any third-party rights.

18. Termination & Account Deletion

We may suspend or terminate your account at any time for violations of these Terms, for fraudulent activity, or at our discretion with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account and all associated data at any time using the in-app "Delete Account" feature in the sidebar, or by contacting us. Account deletion permanently removes your farm records, livestock entries, calendar events, forum posts and replies, marketplace listings, reviews, disputes, support messages, learning progress, and subscription records. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) shall remain in effect.

19. Third-Party Services

The Service integrates with third-party providers including Google APIs, AI model providers (including Google Gemini), payment processors (Paystack), weather data providers, and hosting infrastructure. We are not responsible for the practices or content of these third parties. Your interactions with third-party services are governed by their respective terms and policies.

20. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

21. Governing Law

These Terms are governed by the laws of the Republic of Ghana. Any disputes arising from or relating to these Terms or the Service shall be resolved in the courts of Ghana, without regard to conflict-of-law principles.

22. Severability & Force Majeure

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, government actions, internet outages, or other force majeure events.

23. Ghana Card Identity Verification & Biometric Selfie Check

To access certain features of the Service, including posting marketplace listings, you must complete identity verification using your Ghana National ID card (Ghana Card) and a live selfie. The verification process (Phase 1 MVP — not a professional KYC solution) works as follows: (a) You submit a front-side image of your Ghana Card, which is processed by AI-based optical character recognition (OCR) to extract your full name, card number, date of birth, and other printed details. (b) You capture a live selfie through your device camera (file upload is disabled for the selfie step to ensure the photo is taken in real time). (c) An open-source face-recognition engine runs locally in your browser to detect faces in your selfie and in the Ghana Card portrait, and to generate biometric face embeddings (mathematical representations of facial features). (d) The embeddings are sent to our server, where a decision engine computes a face-match score and determines whether the selfie matches the card portrait. (e) A randomized liveness challenge (e.g., smile, look left) may be issued to confirm the selfie is live and not a photo or recording. (f) The decision engine assigns a status — auto-verified, pending admin review, retry required, rejected, or error. If automatic confidence is low or the biometric engine is unavailable, your attempt is routed to an administrator for manual review; the system never auto-approves when the engine is unavailable. You must explicitly consent to the collection and processing of your facial biometric data (selfie, face embeddings, and liveness analysis) before verification begins. You may decline consent, in which case verification cannot be completed and verified-user features will remain unavailable. Your card images, selfie, face embeddings, face-match score, liveness results, and extracted identity data are stored securely on your VerificationAttempt record and are visible only to you and authorized administrators — they are never shared publicly or sold to third parties. One Ghana Card may be linked to only one account. Attempting to register the same Ghana Card on multiple accounts, submitting a false or altered card, submitting another person's card, or attempting to spoof the selfie or liveness check (e.g., using a photo, video, or mask) is strictly prohibited and may result in immediate account suspension. Verification submissions and decision-engine outcomes are logged for security and audit purposes. You may request deletion of your Ghana Card and biometric data by deleting your account or by contacting us. AgriSmart Ghana reserves the right to reject any verification submission at its sole discretion. The Phase 1 MVP biometric system does not constitute a guarantee of identity and should not be relied upon as a substitute for professional identity verification.

24. Contact Form & Confirmation Emails

The Service provides a Contact Us form that allows users and visitors to submit enquiries, feedback, and support requests. When you submit the contact form, your name, email address, subject, and message are saved to our database and a notification is sent to our support team. An automated confirmation email is sent to the email address you provided, confirming receipt of your message and stating that our team will respond within 24–48 hours. If the confirmation email cannot be sent (e.g., due to an invalid email address or delivery failure), your message is still saved and our team will still receive it. To prevent spam, submissions from the same email address are limited to one per 60 seconds. You do not need to be a registered user to use the Contact Us form.
